MyEMMA Alerts Terms of Use

These MyEMMA Alerts Terms of Use (“MyEMMA Terms”) supplement, and constitute a part of, the EMMA Terms of Use (which are incorporated herein by reference). These supplemental terms and the EMMA Terms of Use (including the disclaimers and limitations of liability in them) apply to your receipt and use of MyEMMA alerts. Please read these MyEMMA Terms carefully because this constitutes a legally binding agreement between you and the MSRB. You may not register for or receive MyEMMA alerts if you do not agree to these MyEMMA Terms. Your registering for or receipt of MyEMMA alerts acknowledges that you have read, understand and accept these MyEMMA Terms and conclusively shall constitute your agreement to be bound by, and comply with, them. Capitalized defined terms used which are not otherwise defined herein have the meanings given to them in the EMMA Terms of Use.

The number of MyEMMA alerts that you may receive may be limited in number. That limit may be changed at any time and from time to time without prior notice. (Certain data and other information is available by subscription, for a fee, from the MSRB on a bulk or streaming basis, as described on the MSRB website at msrb.org.) You shall not, and shall not attempt to, bypass or circumvent the limit by any means, including registering for MyEMMA alerts using more than one email address. The use of MyEMMA alerts, in whole or in part, (including use of CUSIP Numbers and Securities Descriptions contained in them) is not intended to serve as a substitute for any subscription services that the MSRB or any of its third-party licensors offers now or in the future.

If you register for MyEMMA alerts and intend to use them in the course of your employment or independent contractor or other business activities, then you must use your work/ business email address to register for MyEMMA alerts. You may use your personal email to register for MyEMMA alerts if you will receive them in your personal individual capacity, only for personal use (subject to the following sentence). (However, if it is the case that your personal email address is also your formal work/business email address, then you may register using it.) You must provide accurate and complete information in registering, and promptly update it to keep it accurate, including, without limitation, (i) updating your role if it changes and (ii) deleting your account that was registered using an email address at a firm/employer with which you are no longer affiliated.

MyEMMA alerts are for your internal use. You may not, and shall not, copy, publish, reproduce, modify, create a derivative work from, display, distribute, redistribute, sell, license or otherwise transfer (either in printed, electronic or other format) or exploit them, in whole or in part.

At any time and in the MSRB’s sole discretion, the MSRB may modify, suspend or discontinue MyEMMA alerts without notice. We shall have no liability to you or any third party for modification, suspension or discontinuance. The MSRB may suspend or terminate your receipt of MyEMMA alerts (in whole or in part) for any violation or suspected violation of the EMMA Terms of Use, including these MyEMMA Terms, without prior notice.

As more fully described in the EMMA Terms of Use, we may revise these MyEMMA Terms from time to time, without prior notice. You are bound by any upon our posting of them on the Website, and your continued use of the Website (including registration for or receipt of MyEMMA alerts) after the posting of changes conclusively shall constitute your acceptance of and to them.

You consent to and acknowledge that we may provide information relating to you and your use of MyEMMA alerts, including without limitation name, email address or other identifying information, to:

  • third-party licensors whose data or information is included in MyEMMA alerts
  • compliance or other officers or employees of your employer for administrative purposes
